Abstract:The conflict of rights is an obvious organizational phenomenon in the independent colleges jointly held by public schools and social enterprises. In the perspective of new institutional economics, and through the case analysis, the paper finds that the rights conflicts within independent colleges mainly come from conflicts of interest caused by the public domain rents, the appropriable specialized quasirents and the principalagent asymmetric information rents. Correspondingly the paper puts forward some policy suggestions, including further perfecting relevant laws and regulations, strengthening contract management, construction of corporate governance, and strengthening government regulation, etc.
