Abstract: Fairness is the sine qua non of the institutional building,which requires to take both efficiency and fairness into consideration in institutional creation and enforcement.In a modern democratic society,institutional building and bettering need to respect and vindicate the rights of the minority as well as to ensure the rights of the majority. Chinas public servant examination and recruitment system is fair to competitive examinees to certain extent,but it does obstruct certain group of people from entering civil service. Thus, the fairness of such a system should be further promoted.
