Abstract：The process of college students′ innovation and entrepreneurship is accompanied by various risks. Due to lack of understanding of the role of law and the absence of entrepreneurship in legal education in higher education, legal risk has become an important factor of entrepreneurial failure. The types of legal risks of college students′ innovation and entrepreneurship include the form of enterprise establishment, contract management, labor and personnel, intellectual property, finance and taxation. To construct the legal guarantee mechanism for college students′ innovation and entrepreneurship, we must start with the legal education system, the legal aid system, the legal risk prevention platform and the internal system of enterprises.
