Abstract:A new legal system called Behavior Preservation was added to Article 100 of the 2012 revised Civil Procedure Law, thus filling a systemic gap concerning behavior preservation and enriching the denotation and connotation of preservation system. Nevertheless, the wording of Article 100 is too brief to cover the various forms of behavior preservation. What's more, property preservation and behavior preservation can be further categorized according to function, purpose and measure. But the Civil Procedure Law fails to make any distinction of the different types of preservation, so it will give rise to errors in judicatory practice and must be improved.
