Abstract: From Jan. 1st, 2012, EU will include international civil aviation into its Emission Trading System, invoking strong protests from international societies. EU unilateral compulsory behavior violated not only United Nations Framework Convention on Climate Change and Kyoto Protocol but Chicago Convention as well. It not only damaged the results achieved in international climate negotiation, but also hurt the legal interests of nonEU countries. The international communities have taken countermeasures, and China, as a developing country, should also take countermeasures while insisting on principle of common but differentiated responsibilities.
