Abstract：The contractual relationship between government and institutions of higher learning is a new governance mode which is formed in accordance with the contractual spirit and focuses on the allocation of the responsibilities, rights and benefits. In terms of its property, it is an incomplete contract which often takes the form of nonformal contract and is a mixture of administrative contract and civil contract. It is a new mode of governance with distinctive features of the times and quite feasible in reality.
